INTRODUCTION

These terms and conditions of purchase govern your purchases and use of the website www.brunadesignstore.com and constitute a contract between you and BRUNADESIGNSTORE SA DE CV, Federal Taxpayer Registry (RFC): BRU1911018I8, with registered address at Avenida Américas 1254 9B, Col. Country Club, Guadalajara, Jalisco, CP 44610, Mexico. By making a purchase on the website, you agree to these Terms and Conditions of Purchase. Please ensure you read and understand these Terms and Conditions of Purchase before using our website.

CONFIRMATION

Once we receive your order, we will send a confirmation to the email address you provided. Therefore, it is important that you provide your correct email address when placing your order. Please keep this email so you can contact customer service if needed. The order confirmation (receipt) also serves as proof of purchase.

PAY

You can pay with credit or debit cards, Stripe, and PayPal. BRUNADESIGNSTORE does not store credit card numbers.

CARD PAYMENT

Pay securely with Visa, American Express, or MasterCard through Stripe, Conekta, or PayPal online. Your card details are sent directly to the bank, making them impossible for anyone other than the bank to read or access. BRUNADESIGNSTORE does not charge any additional fees or costs for card payments. However, your bank or the merchant where you make your payment may apply additional charges depending on the bank or merchant and the type of card used. If you pay by credit or debit card, the terms and conditions will apply at the time the card transaction is approved. If the charge is not processed, BRUNADESIGNSTORE will send you an email notifying you that the charge was unsuccessful. If payment is not received after the order has been shipped, BRUNADESIGNSTORE may automatically cancel it.

PAYMENT BY INVOICE

It's important that you register the delivery address when purchasing with an invoice. A credit check is typically performed without a complimentary copy. The entire transaction will be handled by Shopify. To obtain your invoice, please contact our customer service at +52 33 2986 0170.

RATES

All prices shown on the BRUNADESIGNSTORE website at www.brunadesignstore.com include Value Added Tax (VAT) in accordance with current legislation.

PLACE AN ORDER

BRUNADESIGNSTORE reserves the right to change prices and correct incorrect prices on all orders, including final sales. If a price is incorrect or a product is out of stock, BRUNADESIGNSTORE may cancel the purchase and refund the amount paid. This may be done at any time.

Consumers have the right to return an order within 14 days of receiving it. This right applies only if the product and its original packaging can be returned in the same condition as when received. The beauty of personalization is that it becomes yours and yours alone, which is why once a product is personalized, it CANNOT BE RETURNED. If consumers exercise their right to return an order, they must contact BRUNADESIGNSTORE to obtain a return address. Return shipping costs are the responsibility of the customer. If an item is damaged during transit, BRUNADESIGNSTORE must be contacted within 14 days to report the damage.

RETURNS

Consumers have the right to return an order within 14 days of receiving it. This right applies only if the product and its original packaging can be returned in the same condition as when received.
Products purchased on promotion or in our discount section are not covered by a warranty. These offers are final and no exchanges, returns, or claims for defects after purchase are accepted.

WARRANTY

BRUNADESIGNSTORE offers a limited warranty covering manufacturing defects for 2 months and personalization defects for 1 month from the order date. To claim under this warranty for replacements, please use our contact form on the "Contact Us" page. In your email, please include your name, address, order number, and a detailed description of the problem. Finally, write "Purchase Claim" in the subject line of the email or letter. Return shipping costs are the responsibility of the customer. If BRUNADESIGNSTORE finds no defects, the product will be reshipped to the customer.

While we strive to ensure the accuracy of all content on this website, errors may occur. BRUNADESIGNSTORE cannot guarantee that all product images accurately reflect the actual product; therefore, all product images should be considered as illustrative purposes only. Product images may appear differently depending on your computer's color settings.

Please note that the personalization service is a manual and entirely handcrafted process. Therefore, your name may be slightly off-center compared to how it would appear if done mechanically.

DELIVERY AND CANCELLATIONS

BRUNADESIGNSTORE ships throughout Mexico. Deliveries are made in collaboration with postal services and their partners. You have the right to cancel purchases and return delivered merchandise by contacting BRUNADESIGNSTORE customer service or using the contact form on the BRUNADESIGNSTORE website within 14 days of receiving the merchandise (www.brunadesignstore.com ), provided the merchandise has not been unpacked and is in the same condition as when received. However, the customer will be responsible for the risk of shipping the merchandise back to BRUNADESIGNSTORE.

In cases where you, as the customer, believe that the delivery is so delayed that you no longer wish to receive the order, it is your responsibility to cancel said order.

In cases where an order has already been shipped, the customer is obligated to accept it. Cancellation is not valid until the customer has confirmed it with BRUNADEISGNSTORE, either by email or telephone. If a product has been discontinued, BRUNADEISGNSTORE reserves the right to cancel the purchase and refund the customer the amount paid. BRUNADEISGNSTORE will notify the customer of any replacement or equivalent products if available.

CLAIMS CONDITIONS

It is important that you, as the customer, carefully inspect the goods/products upon delivery to ensure they are undamaged and correct. If a product is damaged during transit, whether the damage is visible or hidden, you must inform the shipping company as soon as possible. If you notice that your item is damaged or does not match your order, you must also contact us within 14 days of receiving it.

All claims should be directed to our customer service department via our contact form, which you will find on the contact page. Please provide your order number and the reason for your claim, and we will contact you as soon as possible. Please follow the same procedure for returns. Defective products returned to BRUNADESIGNSTORE must be treated as if they were not defective. It is extremely important that all returned products are packaged in such a way that they cannot be damaged during transit. BRUNADESIGNSTORE reserves the right to replace defective products with other products of the same model. If the item is discontinued, the customer will receive a full refund. If no errors or defects are found in the returned product, BRUNADESIGNSTORE will resend the product to the customer.

RESPONSIBILITY

BRUNADESIGNSTORE's liability for delivery errors is limited to the terms and conditions of sale. BRUNADESIGNSTORE assumes no direct or indirect liability for, but is not limited to, incompatibility, delivery delays, downtime, data loss, additional work, or other economic damages.

FORCE MAJEURE

BRUNADESIGNSTORE will be exempt from liability for damages and other penalties if the performance of the contract is prevented, hindered, or delayed by circumstances beyond our control. Such exonerating factors include government intervention, new or amended legislation, absence of state, war, fire, flood, labor unrest, prohibitions, restrictions, sabotage, transportation failures or adverse weather conditions, failure to deliver by suppliers, and the company's exposure to criminal activity affecting its operations.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights, such as trademarks and copyrights, appearing on the website and in the published material, are owned by BRUNADESIGNSTORE or its subsidiaries or licensors. Any use of the site or its content, including copying or storing such content, in whole or in part, for purposes other than personal, non-commercial use, is prohibited without the permission of BRUNADESIGNSTORE.

FRAUD

All frauds will be reported to the Mexican authorities and BRUNADESIGNSTORE reserves the right to cancel the purchase if there is any suspicion of fraud.

APPLICABLE LAW AND COMPETENT JURISDICTION

These terms and your use of the website www.brunadesignstore.com are governed by Mexican law. To the extent permitted by law, Mexican courts shall have exclusive jurisdiction over any dispute arising from these terms of use and your use of the website, subject to BRUNADESIGNSTORE's right to take legal action against a user in their place of residence.

RESCISSION
